As part of the General Counsel’s Office, the Senior Associate General Counsel provides legal advice, direction, and supervision to the Minnesota Sex Offender Program (MSOP) executive team, management and staff regarding any and all pending, threatened, or potential civil, criminal and/or administrative legal actions. The individual in this position is responsible for providing independent legal advice in a variety of complex and changing areas, applicable to the diverse activities of Direct Care and Treatment divisions, facilities and programs. Therefore, the individual requires the ability to understand and apply multiple areas of law on a daily basis.

Specifically, this individual serves as the primary legal counsel for MSOP and provides legal advice and direction on issues including, but not limited to, the Minnesota Commitment and Treatment Act; data privacy; protected health information; operations at DCT facilities; decisional capacity and due process relating to administration of treatment; criminal procedure; legal review of policies; management of litigation; consultation on and drafting of legislative proposals and Department rule making, and matters related to facility licensing. This position will also provide legal advice on employment and labor laws matters.

Minimum Qualifications

· J.D. degree from an ABA accredited law school.

· Currently licensed to practice law in the State of Minnesota.

· 5 years of experience as a practicing attorney in civil commitment, healthcare, privacy or a related field. Experience must demonstrate the following:

o Provision of legal advice interpreting rules, laws, court orders and other legal and/or regulatory materials;

o Knowledge of the legislative process and federal and state laws;

o Strong legal research and oral and written communication skills;

o Exceptional human relations skills and the ability to demonstrate effective problem analysis and problem-solving; and

o Experience providing legal advice to senior management or executives.

Preferred Qualifications

· Possess knowledge of state and federal laws, rules, and regulations relating to the Minnesota Commitment and Treatment Act, the Minnesota Health Records Act, Civil Commitment and Treatment of Sex Offenders, Minnesota mandated reporting statutes, guardianship statutes, employment law, labor law, affirmative action/equal opportunity, criminal procedure, the Health Insurance Portability and Accountability Act, and the Minnesota Government Data Practices Act.

· Experience identifying statutes and rules that apply to individual situations and experience advising decision-makers of the legal consequences for actions or failures to act in compliance with applicable statutes and rules.

· Experience determining the impact of proposed or adopted changes in state or federal law, rule or regulation that impact DCT services, clients and staff.
